The British Columbia Supreme Court has ruled a 2007 lower court ruling unconstitutional, stating that incarcerated women have the right to be with their babies. The ruling stated that by closing the Victoria correctional facilities Mother-baby program, the province did not adequately consider the rights of the mother or children.
